Justice Francis Nyungu Kyambia of the High Court in Kiambu issued conservatory orders on September 28, 2026, suspending the implementation of Gazette Notice No. 10421, which had set the election timetable.
The orders remain in force while the court considers a petition filed by Emelda Kwamboka, a 27‑year‑old resident of Gatundu Constituency, Kiambu County.
Kwamboka, represented by Mukonyi and Company Advocates, argues that the electoral process lacks comprehensive civic education and that the limited online outreach excludes rural youth and persons with disabilities.
She also alleges that the Elections Steering Committees required under the National Youth Council Act have not been formed in any of the 290 constituencies, breaching statutory requirements.
Further complaints cite poor communication of timelines, structures and procedures, and a lack of transparency and accountability in the use of public resources.
Kwamboka contends that these deficiencies violate constitutional principles of public participation, equality and non‑discrimination, marginalising groups the council is meant to protect.
Justice Kyambia granted both interim and final conservatory orders sought in the petition, effectively halting the ward‑level elections slated for October 9, constituency elections for October 16, and the National Youth Congress elections scheduled for October 27‑30.
The case has been listed for a directions hearing on October 26, 2026, to determine the next steps for the petition and the future of the election timetable.
