The High Court ordered fines totalling Ksh21 million against former Kiambu Governor Ferdinand Waititu on three money‑laundering counts linked to a Ksh588 million road‑tender case.
Under Count 10, Waititu was fined Ksh10 million, with a default sentence of five years’ imprisonment if the fine remains unpaid.
Count 11 carries a Ksh6 million fine and a default four‑year prison term, while Count 12 imposes a Ksh5 million fine or a default four‑year term.
The court directed that these new sentences run concurrently with Waititu’s existing 12‑year term, which he is already serving for the same corruption case.
Corporate co‑accused also received fines: Saika Two Estate Developers Ltd was fined Ksh16 million on Count 10 and Ksh8 million on Count 12, while Testimony Enterprises Ltd, the awarded contractor, faced fines of Ksh16 million, Ksh12 million and Ksh8 million on Counts 10, 11 and 12 respectively.
Individual co‑accused included Charles Chege Mbuthia, fined Ksh10 million and Ksh6 million on Counts 10 and 11, and Beth Wangechi Mburu, fined Ksh2 million on each of the three counts.
The court gave the corporate defendants 14 days to settle their fines, warning that failure to pay will trigger statutory enforcement measures.
The case centres on a Ksh588.7 million contract to upgrade gravel roads to bituminous standards across several Kiambu sub‑counties, which investigators said was irregularly awarded and that proceeds were diverted to businesses linked to the accused.
The Ethics and Anti‑Corruption Commission previously reported that Waititu used Saika Two Estate Developers to channel more than Ksh25.6 million and that Ksh7.214 million passed through the Bienvenue Delta Hotel, a property associated with him and his wife.
These penalties arise from the money‑laundering counts after the High Court overturned earlier acquittals and entered convictions on those charges.
