On Friday, 9 October 2026, the court will determine whether seven suspects charged with the murder of Dr Victoria Mutiso on 29 July 2026 will be granted bail or remain in custody pending trial.

The court will receive replying submissions from the defence at 10 a.m. before delivering its decision on the bail and bond applications.

The accused are Rose Mbithe Mulwa (also known as Rose Mbithe Ndetei), Chris Mulwa, Angela Mulwa, police officer PC Elijah Kibelion Kimoi and Kimutai (alias Kim Maritim).

Prosecution officials oppose bail, citing risks of witness interference, obstruction of investigations, possible flight, and alleged post‑murder conduct such as destroying digital evidence and fleeing the scene.

Investigators note that several witnesses are under protection and that their identities are known to some of the accused, raising concerns the suspects could contact or intimidate them.

An affidavit from Dr Mutiso’s husband, David Ndetei, urges the court to reject bail, arguing that the first three accused are his former wife and children, giving them intimate knowledge of potential witnesses and their families.

Ndetei also expressed particular concern over the involvement of a serving police officer among the accused, fearing access to police resources could facilitate further interference.

The defence disputes allegations of mistreatment during the investigation; one accused claims he was tortured and heard officers discuss it, but the prosecution says the claims remain unproven.
