The Environment and Land Court in Nyandarua ruled that Nakuru War Memorial Hospital is the rightful owner of a 25‑acre parcel in Milimani Estate, overturning the county's claim to the land.
The judgment directs Nakuru County Government to vacate the property and withdraw the security officers it had stationed there.
The decision follows a two‑year dispute that began when the county took control of the hospital on 23 January 2024, alleging irregularities in a 50‑year lease extension.
Hospital management had contested the county’s actions in court, seeking recognition of its ownership and an injunction against further interference.
In January 2026, former Nakuru Land Registrar Eric Nyamu testified that he cancelled the lease title because a bank charge existed on the property.
The Attorney General’s office defended Nyamu’s cancellation, with Senior State Counsel Prisca Adomeyon arguing the registrar acted in good faith despite alleged lease irregularities.
The court also ordered the county not to interfere with the hospital’s affairs, effectively restoring the land to the facility.
The hospital has remained closed since the county’s takeover in January 2024, disrupting services that had served generations of patients in Nakuru.
