The Director of Public Prosecutions charged bus driver Jotham Murumba Wanjala with twelve offences following a crash on August 7, 2026, that killed two Technical University of Mombasa (TUM) students and injured several passengers on the Ahero‑Awasi Highway in Kisumu County.
Wanjala appeared before Senior Principal Magistrate Evelyn Makungu Onzere at Nyando Law Courts and denied all twelve counts, which include two charges of causing death by dangerous driving and ten counts of driving without due care and attention.
Principal Prosecution Counsel Douglas Moseti alleged that Wanjala caused the deaths of Evance Odiwour Otieno and Rooney Owek Gakumba by driving in a dangerous manner contrary to Section 46 of the Traffic Act, Cap 403.
The court heard that the driver was travelling at a speed that endangered the public before losing control, causing the bus to veer off the road and overturn near Boya in Nyando Sub‑County.
A Sh500,000 cash bond was set for Wanjala, with no alternative bail, and the case is scheduled for a further hearing on November 5, 2026.
TUM Vice‑Chancellor Prof Laila U. Abubakar confirmed that the students were travelling from Mombasa to Kisumu for the burial of former student leader Elvis “Beast” Otieno, and that the crash occurred as the convoy approached Ahero.
According to the university, the bus overturned after the driver attempted to avoid a head‑on collision with an on‑coming over‑speeding saloon car, leading to the loss of control.
The university reported that two male students died, while 29 others were injured and taken to Lisa Hospital in Ahero and Jaramogi Oginga Odinga Teaching and Referral Hospital for treatment.
