On 14 October 2026 the National Assembly unanimously approved the Breastfeeding Mothers Bill, 2024, sponsored by nominated MP Sabina Chege.

The legislation requires every employer to provide a dedicated lactation room that is clean, quiet, private, warm, lockable and equipped with a washbasin, refrigerator, electrical outlet, lighting, chair, table and storage for breastfeeding equipment.

Employers must also grant reasonable breastfeeding breaks, the length of which will be set by the Cabinet Secretary for labour through regulations, and must consider flexible‑working requests in writing within 14 days, providing reasons for any refusal.

The bill expressly forbids designating bathrooms or toilets as lactation spaces and imposes fines of up to KSh 1 million, imprisonment for up to one year, or both on conviction for non‑compliance.

For public buildings that accommodate at least 50 people, owners, lessees or tenants must install a baby‑changing facility that is clean, private, includes a changing table, waste bucket and clear signage.

The bill also strengthens protection against discrimination based on pregnancy, childbirth or breastfeeding, prohibiting denial of employment or benefits on those grounds.

Implementation will commence one year after the bill is published in the Kenya Gazette, pending presidential assent from President William Ruto.
